  • The value you have lost due to the damage and/or the cost to recover the loss by repairing or replacing the piece of property.

If your car is repairable, you would be entitled to compensation to repair damage from the accident. This is payment for repairs with the same quality parts that were on your car before it was damaged. This means replacement parts made by the original equipment manufacturer or after-market upgrades.

Payment for a totaled car should equal its Kelley Blue Book value (plus compensation for any upgrades).

While you are without a vehicle, you may rent a car and include the rental car costs as part of your property damage claim.

Any type of personal property you might transport in a car could be damaged or lost in a crash and therefore added to a claim, such as:

Ultimately, any compensation you receive will come from the at-fault driver’s auto liability insurance, or from your uninsured/underinsured motorist (UM/UIM) coverage if the at-fault driver is uninsured or does not have adequate insurance to cover your losses. In Kentucky, insurers must offer UM/UIM coverage as part of any auto liability insurance policy.

Minimum liability coverage in Kentucky, which most car owners buy, pays $25,000 for all property damage as a result of an accident. UM/UIM coverage is typically equivalent to your liability coverage.

Initially, you would file a third-party claim against the other driver’s liability insurance. The insurer would process the claim and either offer you a settlement or advise you that it was rejecting your claim. At this point, you may accept the settlement or negotiate for a better settlement from the auto liability provider and file a UM/UIM claim with your insurer.

If neither insurer were to offer you a suitable settlement, you could file a lawsuit against the at-fault driver (whose insurer would be obligated to defend them). This would require you to demonstrate that the other driver caused the accident, the accident caused your property damage, and you are due a certain amount of compensation to be made whole.
