Potential Benefit Claims of Affected Daicel Plant Employees

As a Daicel plant employee affected by the Beaver Dam plant closure, you owe it to yourself and your family to understand your legal rights and the available unemployment benefits to you.

Unemployment Insurance

Kentucky unemployment insurance provides financial assistance to workers who lost their jobs through no fault of their own.

Daicel has stated that all full-time employees will be eligible to collect 13 weeks of severance pay if they remain on the job until released. If you receive a severance package, keep in mind that you are still eligible to collect unemployment benefits starting immediately after you are terminated from your job. The size of the unemployment check depends on the amount of wages you earned while employed. Our Kentucky Courage attorneys can assist you if you have any problem obtaining unemployment benefits.

Workers’ Compensation

Many manufacturing jobs are physically demanding. Some injuries develop gradually over months or years rather than as a result of a specific workplace accident. These injuries are known as wear and tear injuries. Have you developed pain in your back, neck, or joints from the wear and tear caused by your job? Many people associate aches and pains or hearing loss as symptoms of aging. However, the daily trauma of performing a manual job may have accelerated the wear and tear to part of your body.

If you have aches and pains, you should not hesitate to file for workers’ compensation benefits, even though you can’t point to a specific event that caused your pain. Our workers’ compensation attorneys have helped a number of plant workers receive workers’ compensation benefits for accelerated wear and tear. Some have valid claims for both wear and tear and hearing loss. We can help you schedule the medical exams so your application for workers’ compensation benefits can be filed as soon as you are laid off from Daicel Corporation. You still have a right to file a workers’ compensation claim while drawing unemployment benefits. But don’t wait to contact an attorney, or you may lose this option.

Social Security Disability

If you are in your 50s or older and have physical problems, you may have a hard time landing another job and maintaining gainful employment. You may need to file for Social Security Disability benefits if you are eligible. A Social Security disability attorney at Morgan, Collins, Yeast & Salyer can review your individual circumstances and medical record and discuss your legal options for pursuing disability benefits or Social Security early retirement benefits.
