Will I Get a Workers’ Comp Award—or a Settlement?

When you’re fighting for Workers’ Comp benefits, you could get a decision in two major ways:

  • An administrative law judge awards you benefits.
  • You reach a settlement with the workers’ comp insurance company.

If a judge awards you benefits, you’ll receive weekly benefit checks as long as you continue to qualify for Workers’ Comp.

If you agree to a settlement, you’ll likely get a one-time lump sum of money.

You might want a lump sum if you prefer to get more money up front instead of gradually spread over time.

Lump sums aren’t required under Kentucky Workers’ Comp law. This is something you negotiate with the insurance company.

  • The severity of your impairment
